Rite Aid, the nation’s largest non-prescription drug retailer, faces growing competition from Walmart, which has faced legal troubles since it bought a controlling stake in the retailer after a court case.
Rite Aid will now have to pay a $5.35 million fine and pay a $3.4 million judgment against the retailer, which holds the majority stake.
The ruling means that any retailer that buys prescription medicines, such as Pfizer’s Viagra, will have to pay the full cost of the medicines.
The ruling comes several years after a federal appeals court in California held that the sale of prescription medicines, such as Viagra, was illegal under federal health care programs.
“This case represents an attempt by a retailer that sells prescription drugs to a federally funded health care program to avoid paying for drugs the products are not covered by the program,” said Patrick Kounte, a spokesman for the FDA.
“For some, access to essential prescription drugs may be limited, but for others, access is limited and potentially permanent,” Kounte said in a statement.
The ruling will affect many of the nation’s largest prescription drug retailers, including Rite Aid and the National Community Health Plan, Kounte said.

Rite Aid and its affiliate pharmacies may also have to pay a $2.2 billion fine, Kounte said.
